Title: The liability myth
3dddman - April 22, 2006 06:12 PM (GMT)
Somewhere in a back post I saw a comment to the effect that no one would describe the inner workings of a gun because of liability. This is nonsense, although anyone can sue everyone about anything. Think a signed release of liability for selling a functional version of a DS gun would do the seller any good? Think again. Releases are made to be broken, as any good lawyer will tell you. People who win megabuck suits against doctors have signed a ton of releases. The only defense is massive liability insurance. As long as information isn't federally restricted, or classified, or copyrighted, it can be made available. Any public library will have on hand tens of thousands of pieces of potentially lethal information, from plant poisons to outdated building codes. For example, there are hundreds of articles on how to soup up cars. If you did follow the info in one, and wrecked, could you get back at the author? You could try, but you'd probably fail. The actual DS issue is protecting a trade secret, which in a small fan based community, is kind of uncool, seems to me. One would be far more at risk handing a working DS gun over to another person for money than for telling someone how to build one. Kudos to Richard Coyle for making all his DS information public on his site.
Got a new version of a working DS gun? Pull the side plate. Take digital photos. Web publish 'em. You're even further buffered here, because you're telling someone how someone ELSE made one, not how you made one. And you've also upgraded your own kharma in the process. :)

Well a seller has a right to sell anything he wants including dictating Terms on what he brokers.
As far as trade secrets it seems to me you are looking for an easy way out and I can tell you this right now there are NO easy way outs in owning this particular Prop so it probably is not for you.

Actually, a seller doesn't have any rights at all regarding a DS gun.
Its overall design is the intellectual property of MGM. And if someone thinks making a new, improved version of something someone else has primary ownership of gives THEM ownership, well... that's just plain silly. As a new use, you might be able to patent a valve design if MGM's legal department didn't notice. But of course, you couldn't legally sell the rest of the gun without a license. And if you think there's any way in hell MGM would license what amounts to a hand held acetylene torch, it's time to change your meds... ;)
Any seller imposed albatross-like terms of sale are completely bogus and can be ignored with impunity. And if someone hassles an owner of a prop copy for publishing information, tell him or her you'll forward their concerns to the MGM legal department for clarification. That'll shut 'em up.
This is an information sharing forum. So let's share information. Of course I want easy info. Only a fool wouldn't.

Now I KNOW this Prop is not for you!
As far as seller-imposed terms of sale being bogus, Violate one and see if the seller will ever do business with you again! :P
Actually what you seek has been available over the net for Years.
You want to know why not many Builders have done these?
I'm sorry let me put it this way done these AND Succeded?
Because it is an unforgiving Prop that is very dangerous.
The Info you seek is not easy or cheap to come by.
Good Luck!!

Frankly, my dear, I don't give a damn if the seller *ever* does business with me. That ain't the point!
The point is to demistify the process, and most likely, the person who buys a DS bun would never buy anything from the guy who sold it ANYWAY!!! ;)

The point is to demistify the process, and most likely, the person who buys a DS gun would never buy ANYTHING else from the guy who sold it ANYWAY!!! This is a list for Logan's Run fans! Amateurs, from the root Latin word amatus that means means "love of", more or less. Sheesh, some people, I tell 'ya... :angryfire:
